Jobs shouldn't influence Apple/Samsung trial: Judge

SAN JOSE, California: A US judge on Wednesday approved Apple Inc's request to bar disparaging statements by Steve Jobs about Google's Android operating system from an upcoming patent trial against Samsung Electronics Co Ltd.

Apple and Samsung, the world's largest consumer electronics corporations, are waging legal war in several countries, accusing each other of patent violations as they vie for supremacy in the fast-growing market for mobile devices.

Samsung's phones and tablet run on the Android operating system, developed by Google.

Before he died last year, Apple co-founder Jobs made a number of statements to his biographer about the company's intellectual property, saying he was willing to go "thermonuclear" to "destroy" Google's operating system.

In seeking to introduce Jobs' statements in court, Samsung argued in a filing that the thermonuclear quote "speaks to Apple's bias, improper motives and its lack of belief in its own claims in that they are a means to an end, namely the destruction of Android."

However, Apple argued in a court filing that Jobs' quotes are an inadmissible distraction, and asked that they be barred from trial. At a hearing in a San Jose, California federal court on Wednesday, US District Judge Lucy Koh said Jobs' statements were not relevant.

"I really don't think this is a trial about Steve Jobs," Koh said.

Apple sued Samsung last year, claiming the South Korean company blatantly copies its designs for the iPhone and iPad. Samsung denies the allegations and has countersued.

The trial is scheduled to begin July 30. Apple has won pretrial injunctions against the Galaxy Tab 10.1 and the Galaxy Nexus phone. Samsung is appealing both injunctions.

In another case in the smartphone wars, Chicago federal judge Richard Posner had said Jobs' quotes would be fair game in a trial between Apple and Google's Motorola Mobility unit. However, Posner eventually dismissed that case before trial, saying neither side could prove damages.

Also on Wednesday, Koh ruled that evidence about Apple's operations in China could be discussed, but could not be cast as human rights problems. Evidence of Samsung's taxes paid in the US could also be discussed, Koh ruled, but Apple would not be able to make any insinuations of tax avoidance.

The case in US District Court, Northern District of California, is Apple Inc v. Samsung Electronics Co Ltd et al, 11-1846.

Man Gets Two Years In Jail For Home Improvement Scam ? CBS ...

ANNAPOLIS, Md. (WJZ) ? Two years in jail. That?s the sentence handed down Wednesday to an Annapolis man who scammed homeowners in Anne Arundel County out of thousands of dollars in a home improvement scheme. Rochelle Ritchie has more on the verdict and the money he has to pay back.

This case revolves around Thomas Edward Clack, who pled guilty back in March for doing thousands of dollars in contract work with a Maryland license. Now he?ll pay with time in jail and money out of his pocket.

After being called a shameless swindler and pathological liar by the judge, Clack was sentenced to two years in jail for his role in a paying scam that cost some homeowners like James and Sandra Park nearly $22,000.

?We were sitting on our couch when he gave us the amount and I said that cannot be,? Sandra Park said.

Anne Arundel County police say for several weeks, Clack targeted unsuspected homeowners like the Parks, promising to pave their driveways for a fair amount.

?He comes back with a crew, he performs the work but charges a substantial amount more money than what he initially discussed with the victims,? said a police official.

Clack pled guilty in March to charges of acting as a contractor without a license and selling home improvements without a license. He was supposed to be sentenced in May but that was postponed so he could raise funds to pay his restitution. He never paid and Wednesday homeowners again walked away empty-handed.

?You can?t get blood out of stone. If the guy doesn?t have money, he doesn?t have money,? said Myron Kandra.

Despite his guilty plea in Maryland, prosecutors say Clack continued more illegal paving in other states. They argue he earned $170,000, well over the $63,000 he owes in restitution.

In the courtroom, Clack turned and apologized to his victims, but they weren?t buying it.

?Don?t mean a damn thing,? said James Park.

After serving his two years, the judge ordered Clack to be on probation for five years and pay the rest of his restitution. The victims say they don?t expect to see a dime.

?I have little faith in that,? Sandra Park said.

Clack faces additional charges for similar crimes in Florida, North Carolina and South Carolina, as well as in Prince George?s and Queen Anne?s counties.

In court, Clack admitted to overcharging his clients.

A Carrot for Windows 8's Stick

When companies are planning for a migration to Windows 8 they're going to devote a lot of attention to various virtual desktops, and that's understandable. For many situations, though, a new deployment option -- Windows To Go -- may be the perfect solution for mobile employees.

I've had a chance to play a bit with Windows To Go, and I'm excited about the possibilities that this operating system on a stick has for mobile workers and the IT groups that manage them.

Linux fans have pooh-poohed the coming USB-hosted Windows 8 version, correctly noting that users have been able to launch Linux from a USB thumb drive for years. They're right, of course, though in the context of most enterprise desktop computing, no one cares. For enterprise Windows users, the availability of an (almost) fully featured Windows 8 instance on a thumb drive could be a game-changing development for many mobile professionals. To understand just how Windows To Go could work for you, it helps to understand what it doesn't do.

Much like a virtual desktop, Windows To Go rests on the platform of a particular desktop or laptop computer while insulating the Windows To Go user from private or potentially hazardous data on that computer (and vice versa). By default, access to the host computer's internal hard drive(s) is not allowed from a Windows To Go session.

The good news is that this allows a Windows To Go user to boot a session on any available hardware without worrying about corrupting the OS image with malware on the host, or about accidentally damaging information on the host through the use of Windows To Go.

The bad news is that, unlike Linux on a stick, Windows To Go can't be used as a "rescue disk" by roving IT pros called upon to do emergency system support.

For mobile professionals who need a personalized desktop but don't need the weight and bother of a full portable system, Windows To Go could be the perfect answer. One of the questions I'm often asked is about situations in which a virtual desktop isn't a good answer. My most frequent answer is that desktop virtualization is problematic without a reliable Internet connection. That's not a problem for Windows To Go, making it a superb option for employees who have to work at remote customer sites (or business locations) that don't have broadband Internet connectivity.

Microsoft has equipped Windows To Go with Bitlocker, making it a secure installation option suitable for employees who must conform to HIPAA, FERPA, or other federal privacy regulations. The security is enhanced by the behavior of Windows To Go when the USB drive is removed from the system. When the USB drive is no longer attached, the instance stops working. If the drive is reconnected within 60 seconds, the session continues. If not, the computer shuts down and virtually all traces of the Windows To Go session are erased. (A handful of device drivers remain to speed boot on subsequent sessions, but no individual information is left on the system.)

It's important to note that simply yanking the USB drive out of the system doesn't corrupt the Windows To Go instance or any individual data, making this "emergency" shutdown method applicable for first responders, military users, and healthcare pros who need to "yank and go" rather than waiting for the computer to shut down.

IT departments will need to analyze their individual use cases, but Microsoft has given the enterprise some important new tools with Windows To Go. It is, to be honest, one of the things that most excites me about Windows 8, and one of the things that companies will want to carefully examine as they plan their migration to the newest operating system from Microsoft.

Sona Discovers Potential High-Grade Gold Mineralization
at Blackdome in British Columbia -- 13.6g over 1.5 Meters

VANCOUVER, British Columbia -- With its latest surface diamond drilling program at its 100-percent-owned, formerly producing Blackdome gold mine in southern British Columbia, Sona Resources Corp. has discovered a potentially high-grade gold-mineralized area, with one hole intersecting 13.6 grams of gold in 1.5 meters of core drilling.

"We intersected a promising new mineralized zone, and we feel optimistic about the assay results," says Sona's president and CEO, John P. Thompson. "We have undertaken an aggressive exploration program that has tested a number of target zones. Our discovery of this new gold-bearing structure is significant, and it represents a positive development for the company."

Sona aims to bring its permitted Blackdome mill back into production over the next year and a half, at a rate of 200 tonnes per day, with feed from the formerly producing Blackdome mine and the nearby Elizabeth gold deposit property. A positive preliminary economic assessment by Micon International Ltd., based on a gold price of $950 per ounce over eight years, has estimated a cash cost of $208 per tonne milled, or $686 per gold ounce recovered.

Prophecy Platinum Announces Wellgreen Preliminary Economic Assessment:
38% Pre-Tax IRR, $3.0 Billion NPV, and a 37-Year Mine Life

VANCOUVER, British Columbia, Canada -- Prophecy Platinum Corp. (TSX-V: NKL, OTC-QX: PNIKF, Frankfurt: P94P) reports the results of an independent NI 43-101-compliant preliminary economic assessment for its fully owned Wellgreen nickel-copper-platinum group metals project in the Yukon Territory.

The independent assessment, prepared by Tetra Tech, evaluated a base case of an open-pit mine (with a mining rate of 111,500 tonnes per day), an on-site concentrator (with a milling rate of 32,000 tonnes per day), and an initial capital cost of $863 million. The project is expected to produce (in concentrate) 1.959 billion pounds of nickel, 2.058 billion pounds of copper, and 7.119 million ounces of platinum, palladium, and gold during a mine life of 37 years with an average strip ratio of 2.57.

The financial highlights of the preliminary economic assessment, shown in U.S. dollars, are as follows:

Payback period: 3.55 years
Initial capital investment: $863 million
IRR pre-tax (100% equity): 38 percent
NPV pre-tax (8% discount): $3 billion
Mine life: 37 years
Total mill feed: 405.3 million tonnes
Mill throughput: 32,000 tonnes per day

Prophecy Chairman John Lee says: "We are pleased with the preliminary economic assessment results. The numbers indicate that Wellgreen is one of most exciting mineral projects in the Yukon. The company is drilling to upgrade and expand the resource base. Human eye inspires clog-free ink jet printer invented by MU researcher

COLUMBIA, Mo. -- Clogged printer nozzles waste time and money while reducing print quality. University of Missouri engineers recently invented a clog-preventing nozzle cover by mimicking the human eye.

"The nozzle cover we invented was inspired by the human eye," said Jae Wan Kwon, associate professor in the College of Engineering. "The eye and an ink jet nozzle have a common problem: they must not be allowed to dry while, simultaneously, they must open. We used biomimicry, the imitation of nature, to solve human problems."

Kwon's invention uses a droplet of silicone oil to cover the opening of the nozzle when not in use, similar to the film of oil that keeps a thin layer of tears from evaporating off the eye. On the surface of the human eye, eyelids spread the film of oil over the layer of tears. However, at the tiny scale of the ink jet nozzle, mechanical shutters like eyelids would not work, as they would be stuck in place by surface tension. Instead, the droplet of oil for the nozzle is easily moved in and out of place by an electric field.

Kwon said this invention could make home and office printers less wasteful. To clear a clogged nozzle in most ink jet printers, a burst of fresh ink breaks through the crust of dried ink which forms if the machine isn't used constantly. Over time this cleaning operation can waste a large amount of expensive ink. Kwon's invention eliminates the need to waste that squirt of ink.

"Other printing devices use similar mechanisms to ink jet printers," Kwon said. "Adapting the clog-free nozzle to these machines could save businesses and researchers thousands of dollars in wasted materials. For example, biological tissue printers, which may someday be capable of fabricating replacement organs, squirt out living cells to form biological structures. Those cells are so expensive that researchers often find it cheaper to replace the nozzles rather than waste the cells. Clog-free nozzles would eliminate the costly replacements."

Similarly, rapid prototyping systems used by engineers and product designers emit streams of liquid plastic through nozzles like those on an inkjet printer. The thick, sticky liquid used in the devices can make it necessary to replace the whole nozzle when they become clogged. These specialty printer parts can cost thousands of dollars.

MU engineering doctoral student Riberet Almieda worked with Kwon on the oil droplet nozzle cover. A paper documenting the discovery was published in the Journal of Microelectromechanical Systems.

Apple pulls out of environmental ratings registry

SAN FRANCISCO (AP) ? Apple's withdrawal from an environmental ratings registry has prompted at least one city ? San Francisco ? to stop buying its computers.

The decision does not apply to iPads or iPhones. But Francis Tsang, spokesman for Mayor Edwin Lee's office, says the city's rules require that laptops, computers and monitors comply with the registry's requirements.

Late last month, Apple Inc. told the nonprofit EPEAT, short for Electronic Product Environmental Assessment Tool, to remove its products from its registry. It also plans to stop submitting its products to EPEAT for environmental ratings.

EPEAT is an industry standard that seeks to make it easier for customers to buy environmentally friendly electronics. Manufacturers still participating include Dell Inc., Hewlett-Packard, Lenovo, Samsung and Sony.

Apple did not respond to messages for comment Wednesday afternoon.

Although it pulled out of the environmental registry, Apple has long pointed to its environmental track record. On the "environment" section of is website, Apple says it "reports environmental impact comprehensively. We do this by focusing on our products: what happens when we design them, what happens when we make them, and what happens when you take them home and use them."

For example, the Cupertino, Calif.-based company has replaced many of the hazardous materials in its gadgets with less harmful and more recyclable ones, and has designed longer-life batteries for its computers, media players and phones. Its recycling program offers gift cards to people who send in their old Apple gadgets for recycling.

JPMorgan report may show how to lose $5B

When JPMorgan reports its quarterly results Friday morning, most investors will be eager to hear just one key piece of information: How much of a splash did the London Whale make for the bank?

In mid-May, the bank announced it had sustained a multibillion-dollar loss that originated in its London office because of a failed hedging strategy undertaken by Bruno Iksil, nicknamed ?The London Whale? because of the size of the trading positions he took.

Since then, JPMorgan CEO Jamie Dimon has appeared on Capitol Hill to explain the massive loss, which the New York Times reports has grown from the $2 billion originally reported to about $5 billion.

?Investors want to understand what happened, who knew what and when,? Betsy Graseck, a managing director for Morgan Stanley, told CNBC Thursday.

Bank earnings don?t usually attract much attention outside the Wall Street community of analysts, traders and other financial industry observers.?The JPMorgan report is likely to spur greater interest because of the massive trading loss, which has enraged public opinion and led to Dimon appearing on television and two Congressional panels to own up to his company?s mistakes.

Graseck said it will be important for Dimon, for investors and for the?public?to set the record straight on the trading loss. He needs to detail exactly how much of the disastrous trade has been ?unwound? so?the company can move ahead and avoid any future volatility in its stock price that may arise from uncertainly over deeper losses.

?The question is how much [of the trade] is left to go, and what is the volatility on what?s left,? Graseck said.

Investors and the public will want to hear details of how much money will be recovered from top executives at the bank involved in the botched trade.

When he appeared before lawmakers last month to explain his bank?s multi-billion dollar losses, Dimon said the trading debacle will lead to ?clawbacks? -- efforts to recover compensation paid to employees whose performance was later found to have harmed the company and shareholders.

Ina Drew, the former chief investment officer who oversaw the London office where the bank?s botched trade originated, is likely to see her pay curtailed, according to reports, and so is Iksil,?according to a report in the U.K?s Telegraph newspaper.

Since May a handful of other financial scandals have hit the headlines, including news of a global rate-fixing scandal at U.K. bank Barclays and some $200 million missing from customer accounts at Iowa brokerage PFGBest.

These negative headlines are threatening to erode investor confidence in the financial services industry, said Bart Naylor, an expert in financial regulation at the consumer advocacy group Public Citizen.?Dimon is likely to want to restore investor confidence after the trading error, which has wiped $23 billion off JPMorgan?s market value since it was announced on May 10 and has marred his reputation as one of the industry?s best risk managers.

Given his initial, sanguine response to the trading loss, when he called it a ?tempest in a teacup,? Dimon appears to have been unable initially to?comprehend the gravity of the error, Naylor said.?Now, with the bank?s share price down 16 percent since it reported the loss, shareholders are showing they have ?far less confidence? in the bank?s ability to judge risk, he added.

?He?s depending on people who have skills he doesn?t understand,? Naylor said. ?That may be okay for a CEO in the computer software industry who doesn?t need know how to write code, but [at a bank] this has had a material effect on the company, and shareholders are affected.?

JPMorgan is the first big bank to report its earnings for the second quarter, and it will be watched as a barometer for the rest of the industry. Analysts expect the bank to report net income that is about half the $5.4 billion reported for the same period last year, which would mean that the trading loss wipes out much of the profit for the quarter. JPMorgan also reported a net income of $5.4 billion in the first quarter of 2012.

Whatever the quarterly results, Dimon still has a fan in billionaire investor Warren Buffett, who in an interview on CNBC Thursday endorsed the bank CEO as ?one of the best bankers in the world? who ?understands banking and understands risk.?

?If I owned a bank in Omaha and I could get Jamie to run it for me I?d be very happy,? he said. ?Jamie understands risks,? he added, noting that the actions of the London trader Iksil were by one person who ?went off the reservation? and didn?t represent company policy.

NIST releases second draft of federal ID credential security standard for comment

The National Institute of Standards and Technology (NIST) has released the second-round draft version of its updated security standard for identity credentials in the Personal Identity Verification cards (PIV cards) that all federal employees and contractors must use. NIST is requesting comments from the public on the document, which is intended to be the last draft before the final version is published.

The document is the next step toward updating Federal Information Processing Standard (FIPS) 201, which was published in February 2005. Among its requirements are that all PIV cards contain an integrated circuit chip for storing electronic information, a personal identification number and protected biometric dataa printed photograph and two electronically stored fingerprints.

According to NIST computer security researcher Hildegard Ferraiolo, the update was anticipated from the start. "The original FIPS 201 indicates the standard should be reviewed after five years to see if changes need to be made," says Ferraiolo. "After implementing the standard, federal departments and agencies learned a number of lessons that, combined with technological changes over the years, made an update worthwhile."

Ferraiolo says the update will not require anyone to replace their current PIV card, but will make the new cards, based on the revised specification, more flexible and effective. Among the numerous improvements in the revised draft are the abilities to:

• Update a card's credentials remotely without the need to appear in person at the issuer site, a change that should create significant cost savings.
• Create additional credential(s) for use on mobile devices such as smart phones.
• Offer additional capabilities, such as secure messaging and on-card fingerprint comparison, to provide more flexibility in selecting the appropriate level of security for federal applications that use the PIV card for authentication.

Comments on the revised draft of FIPS 201 will be incorporated and targeted to be published as the final version, to be entitled FIPS 201-2. The document, Personal Identity Verification of Federal Employees and Contractors, is available at http://csrc.nist.gov/publications/PubsFIPS.html.

NIST also is requesting comments on a related FIPS support publication, the Biometric Data Specification for Personal Identity Verification (NIST Special Publication 800-76-2). The draft update to SP 800-76-2 amends the 2007 biometric data specifications to include new card options: Agencies will be able to use iris recognition as a biometric, on-card fingerprint comparison instead of a 6-digit personal identification number for card activation. The draft also extends and refines the biometric sensor and performance specifications for improved security. The draft revision of SP 800-76-2 is available at http://csrc.nist.gov/publications/PubsFIPS.html.
